Manslaughter Lawyer
Within the US Code, Manslaughter is deemed the unlawful killing of a human being without malice. There consist of two types, considered by the law. The first, also known as voluntary, is described as happening during a sudden quarrel or heat of passion. Involuntary, the second, is during the commission of a non-felonious, unlawful act, without due caution or circumspection. The primary goal of a criminal defense lawyer is to present the truth in such thorough detail that the defendant will be soon vindicated thus being exercised from all current charges.
A charge of manslaughter, if not taken care properly can be enhanced to any of the following related crimes below:
Murder
First degree murder
Second degree murder
Capital murder
Excusable homicide
Negligent homicide
Justifiable homicide
Vehicular homicide
Attempted murder
Other area’s that may be incorporated within a manslaughter case consists of Mens Rea and Actus Reus. Mens Rea, or the mental mind set of the person committing the crime, deals with the element of killing or seriously injuring a person negligently or recklessly. Actus Reus, is the actual commission of killing another human being. Therefore, extreme consideration is given to these elements in determining the penalty of the responsible party for the fatality.
