According to Indiana code, burglary occurs when:

    • A person breaks and enters the building or structure of another person, with intent to commit a felony:
    • A person who commits burglary will be charged with a Class C felony. The offense becomes a Class B felony if the offence is committed while armed with a deadly weapon, if the building or structure is a dwelling, or if the structure is used for religious worship.
    • The offence becomes a Class A felony if the offence results in bodily injury or serious bodily injury to any person other than a defendant.
